Commercial General Liability Policy (CGL)
General Liability is a broad commercial policy that covers liability exposures of a business that are not specifically excluded.
Commercial General Liability (CGL) insurance protects business owners against claims of liability for bodily injury, property damage, and personal and advertising injury (slander and false advertising).
Premises/operations coverage pays for bodily injury or property damage that occurs on your premises or as a result of your business operations.
Products/completed operations coverage pays for bodily injury and property damage that occurs away from your business premises and is caused by your products or completed work.
Business Owners Packages or BOPs
Business Owners Packages are policies that combine property, liability and business interruption coverage for small- to medium-sized businesses. Coverage is generally less expensive than if purchased through separate insurance policies. These policies could include property coverage for an owned building or business personal property coverage for your contents and improvements and betterments.
Professional Liability/Malpractice Insurance
Professional liability coverage is for engineers, surveyors, accountants, consultants, physicians, lawyers, and other specialists against suits alleging negligence or errors and omissions that have harmed clients.
Business Income Insurance (a.k.a. Business Interruption Insurance)
Business Income Insurance is commercial coverage which reimburses a business owner for lost profits and continuing fixed expenses during the time that a business must stay closed while the premises are being restored because of physical damage from a covered peril, such as a fire. Business interruption insurance also may cover financial losses that may occur if civil authorities limit access to an area after a disaster and their actions prevent customers from reaching the business premises.
Worker’s Compensation
Workers’ compensation is a state-regulated insurance program that handles the employer’s obligation to workers who are injured or made ill due to a workplace exposure. Workers Compensation is not required by statute in Texas (in most cases) but, employers who choose not to provide Workers Compensation to their employees still have obligations.
The employer must file an annual notice with TDI DWC, post notices at their work site that they are not providing workers compensation, and then tell each new employee in writing that they are not being provided with worker’s compensations coverage.
If an employee sues an employer who is not providing Workers Compensation coverage, the employer cannot argue in court that the injured employee’s negligence caused the injury; another employee’s negligence caused the injury; or the injured employee knew about the danger and voluntarily accepted it. This is a very important but, very misunderstood coverage that every business owner should carefully consider.
Liquor Liability
Liquor liability coverage can protect your business from exposure of selling, serving or assisting in the purchase of alcohol. Bars, restaurants, clubs, spas, resorts, are all likely establishments that would require liquor liability. This coverage may also be needed for a company (or “host”) that is holding a special event, party, corporate retreat or any other function where the company or a hired vendor is serving alcohol. Liquor liability coverage can be purchased as a stand-alone policy or added by endorsement to a general liability policy.
Excess Liability Policy
Excess liability is purchased in $1mm increments and is an extension of an underlying liability policy to increase the total available liability limit.
Umbrella Policy
The Umbrella policy is an important coverage which will extend the liability limits of an underlying general liability policy and commercial auto policy plus provide coverage for exposures not covered by the underlying CGL as long as there is not an exclusion endorsement in the umbrella policy.
Commercial Auto
Business Auto Policies are most common as they provide the correct auto insurance coverage for most businesses. These policies are not unlike a personal auto policy in that they can provide liability, uninsured motorist, underinsured motorist, physical damage, medical payments, personal injury protection (PIP), roadside assistance and rental reimbursement coverages. The difference is in the way the policy is rated based on the business classification of the business, radius of operations, numbers of trips per day, and if vehicles used for business only or business and personal as well as many other factors not taken into account on a personal auto policy.
There are other commercial auto risks which require specialized coverage. These risks would include motor carriers, auto related businesses and trucking firms.
Data Breach and Cyber Liability
Data breach insurance and cyber liability insurance help cover the costs of a data security breach for things like identity protection solutions, public relations, legal fees, liability and more depending on the coverage you choose. It is most important to have data breach coverage in place if your business is victimized by a cyber-attack as quick action is critical to help restore the public’s confidence.
To mitigate the risk of civil litigation and other penalties when a data loss or theft occurs, a cyber liability or data breach insurance policy can provide access to professional assistance to help businesses comply with applicable laws and regulations.
Businesses must respond swiftly to minimize the impact of a data security incident on their customers, employees and their business. Their reputation is at risk, and there are laws and regulatory requirements that must be addressed immediately, or companies that experience a breach could face steep penalties and even lawsuits.
